Huawei files motion against U.S. ban: it's unconstitutional

Huawei filed a motion on Tuesday against a "bill of attainder" that the U.S. Congress passed last year that bans government agencies from buying Huawei equipment, asking the court to declare the law unconstitutional.

The 2019 National Defense Authorization Act has directly and permanently targeted Huawei "without opportunity for rebuttal or escape," said Song Liuping, Huawei's Chief Legal Officer.

Song said in a statement that the law is a "quintessential bill of attainder and a violation of due process" and it is aimed at pushing Huawei out of the U.S. market.

"The U.S. Constitution prohibits Congress from passing any 'bill of attainder'—a law punishing a person or group without a trial," said Song.

Song said he hopes the U.S. court will ban the law as it did to bills of attainder and cases that violated due process before.

Song's statement was published by media outlets including The Wall Street Journal.

The US Congress prohibited U.S. government agencies from contracting with Huawei or companies that use Huawei equipment in the 2019 National Defense Authorization Act.
